1. Who we are

These Terms of Service (“Terms”) govern your access to and use of composty.earth and related sub-pages (the “Site”) and your purchase of our products (the “Services”).
Composty Ltd, 48 Kingsley Road, Kingswinford DY6 9RX, United Kingdom (“Composty”, “we”, “us”, “our”) is the provider of the Site and seller of the products.

Our store is hosted on Shopify Inc., which provides the e-commerce platform.

2. Agreement to these Terms

By accessing the Site or placing an order, you agree to be bound by these Terms, our Privacy Notice and Returns & Refund Policy. If you do not agree, do not use the Site.

3. Eligibility

You must be at least the age of majority in your place of residence to use the Site or purchase products, or have permission of a parent/guardian. Our products are for personal/household use.

4. Your account

You’re responsible for keeping your account credentials confidential and for all activity under your account. Tell us right away if you suspect unauthorised use.

5. Products, pricing and availability

  • Product images and colours are for illustration; minor variations may occur.

  • We may change or discontinue products or prices at any time before order acceptance.

  • All prices include VAT where applicable and exclude delivery charges shown at checkout.

6. Orders and contract formation

Your order is an offer to buy. We accept only when we send an order confirmation email. If we reject or cancel an order (e.g., due to stock, pricing error, suspected fraud), we’ll refund any payment taken.

7. Payment

We accept payment methods shown at checkout. You authorise us (and our payment providers) to charge the order total. If your payment fails, we may cancel or suspend the order.

8. Delivery, risk and title

We deliver to the addresses offered at checkout. Delivery estimates are not guaranteed.
Risk in the products passes to you on delivery; title passes when we receive full payment.

9. Consumer cancellation rights (UK & EEA)

If you are a consumer, you have a statutory right to cancel most online purchases within 14 days of delivery without giving any reason under the Consumer Contracts Regulations 2013. To exercise this right, email info@composty.earth with your order number and clear statement of cancellation. You must send the goods back within 14 days of telling us you’re cancelling. We’ll refund the product price and the standard outbound delivery cost; you pay the return postage.

These rights are in addition to our goodwill policy in Section 10.

10. Our goodwill Returns & Refund Policy (no-quibble 30 days)

We also offer a no-quibble 30-day return—even if used—for customers who didn’t love the product.

  • How to request: email info@composty.earth within 30 days of delivery with your order number and what you’re returning. Wait for return authorisation and instructions.

  • Condition: new or used is fine; please rinse/dry used items and pack cleanly.

  • Postage: for change-of-mind, you pay return postage. If an item is faulty, damaged or incorrect, we’ll cover reasonable return postage or provide a prepaid label.

  • Refunds: to the original payment method once we receive and check the return (banks typically take 3–5 working days after we process).

  • Exclusions: final-sale/clearance items (clearly marked) and gift cards.

This policy does not affect your statutory rights (Section 13).

11. Faulty or misdescribed products

If a product is faulty or not as described, you may be entitled to repair, replacement or refund under the Consumer Rights Act 2015. Contact info@composty.earth with photos and your order number.

12. Promotions, vouchers and gift cards

Promotions are subject to their own terms and may be withdrawn at any time. We may cancel misuse or suspected fraud. Gift cards are non-refundable and expire only where permitted by law and as stated at purchase.

13. Your legal rights – important

Nothing in these Terms excludes or limits any rights you have as a consumer under law.
Nothing limits or excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Your statutory rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations remain unaffected.

14. Disclaimer of warranties (service availability)

We use reasonable skill and care to provide the Site but do not guarantee it will be uninterrupted, timely, secure or error-free. Content is provided for general information.

15. Limitation of liability

To the extent permitted by law, we are not responsible for: (a) losses not caused by our breach; (b) any business losses (loss of profit, revenue, contracts, data, goodwill); or (c) losses that were not reasonably foreseeable.
To the extent permitted by law, our total aggregate liability to you for any claim relating to a purchased product is limited to the amount you paid for that product.

16. Acceptable use

Do not misuse the Site, introduce malware, attempt unauthorised access, scrape or harvest data, or use the Site for unlawful purposes. We may suspend or terminate access for suspected abuse.

17. User content (reviews, comments)

By submitting reviews or comments, you grant us a worldwide, royalty-free licence to use, reproduce and publish that content in any media to operate and promote our Services. Keep content lawful and accurate; do not infringe others’ rights. We may moderate or remove content at our discretion.

18. Third-party services and links

Third-party tools and links may be provided “as is.” We don’t control and aren’t responsible for third-party sites or terms. Review their policies before engaging.

19. Privacy

20. Chargebacks and disputes

Contact us first at info@composty.earth and we’ll do our best to resolve issues quickly. Initiating a payment dispute without contacting us may delay resolution.

21. Events outside our control

We’re not liable for delays or failure to perform due to events beyond our reasonable control (e.g., strikes, carrier failures, extreme weather). We’ll keep you informed and work to minimise impact.

22. Changes to the Services or Terms

We may update products, pricing or features and may update these Terms from time to time. We’ll post the latest version on this page with the new date. Continued use of the Site after changes means you accept the updated Terms.

23. Assignment

We may assign or transfer our rights and obligations under these Terms; this won’t affect your statutory rights. You may not assign your rights without our consent.

24. Severability and waiver

If any part of these Terms is found unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver of that right.

25. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction (you may have rights to bring proceedings in your local court).
